 Novelty requirements:

Absolute novelty is required. An industrial design shall be considered new if it has not been disclosed to the public, anywhere in the world, by publication in tangible form or by use or in any other way, prior to the filing date or, where applicable, the priority date of the application for registration.

The disclosure to the public of the industrial design shall not be taken into consideration if it occurred within six months preceding the filing date or, where applicable, the priority date, of the application, and if it was by reason or in consequence of acts committed by the applicant or his or her predecessor in title or an abuse committed by a third party in relation to the applicant or his or her predecessor in title.

An industrial design shall not be considered new solely by reason of the fact that it differs from an earlier industrial design in minor respects or that it concerns a type of product different from a product embodying an earlier industrial design known in and outside of Seychelles.


An industrial design must be independently created and new. "Industrial design" means any composition of lines or colours or any three-dimensional form whether or not associated with lines or colours, provided that such composition or form gives a special appearance to a product of industry or handicraft and can serve as a pattern for a product of industry or handicraft.

An industrial design shall not be protected where:

  • it is contrary to public order or morality; or
  • the design is functional and serves solely to obtain a technical result.

The application may relate to two or more designs incorporated in products belonging to the same class in the international classification.

 Filing Requirements:

  • Power of Attorney (notarised) (can be late filed within two months)
  • Drawings or photographs of design (required on the day of filing)
  • Indication of the kind or class of the product for which the design will be used
  • Certified copy of priority document, if priority claimed (can be late filed)
  • Sworn Translation of Priority Document if not in English (can be late filed)
  • Assignment (can be late filed)
  • May be accompanied by a specimen of the article embodying the industrial design
  • Any industrial design which is three-dimensional, whether fully or in part, shall clearly state so on the document or material

Duration and Renewal:

Design registration is valid for an initial term of five years from the filing date, which is renewable upon payment of the required fees for two further terms of five years each. Renewal fees must be paid within ninety days prior to the expiration of the period of protection.
